By visiting our website, placing an order, or purchasing a product from us, you agree to these Terms of Service. Please read them carefully before placing an order.
1. About SweetNote
SweetNote creates handcrafted and personalized chocolate gifts for birthdays, anniversaries, celebrations, special occasions, and everyday moments.
Throughout these Terms, the terms “SweetNote,” “we,” “us,” and “our” refer to SweetNote and its operators. The terms “you” and “your” refer to customers and visitors using our website.
2. Online Store Terms
By using our website and purchasing from SweetNote, you confirm that you are legally capable of entering into a binding agreement or have permission from a parent or legal guardian where required.
You may not use our products, website, or services for any unlawful or unauthorized purpose.
You may not attempt to interfere with, damage, misuse, or gain unauthorized access to our website or systems.
3. Products & Availability
All SweetNote products are subject to availability.
Because our products are handcrafted, the appearance of the finished product may vary slightly from photographs displayed on our website.
Variations may include differences in:
- Color or shade
- Decorative placement
- Chocolate appearance
- Molded decorations
- Sprinkles, flowers, hearts, or other decorative elements
- Packaging or ribbon
- Overall handcrafted appearance
These reasonable variations are not considered defects.
We reserve the right to modify or discontinue products, designs, packaging, ingredients, personalization options, or other offerings at any time.
4. Personalized Orders
Many SweetNote products are created specifically for the customer and may include personalized names, ages, dates, messages, colors, or other details.
You are responsible for reviewing all personalization information before submitting your order.
SweetNote is not responsible for spelling errors, incorrect dates, incorrect names, or other errors entered or approved by the customer.
We reserve the right to refuse personalization containing content that is unlawful, threatening, hateful, discriminatory, obscene, infringing, or otherwise inappropriate.
Once production begins, personalized orders generally cannot be changed or cancelled.
5. Product Images
We make reasonable efforts to display our products accurately.
However, colors and appearance may vary depending on your device, screen settings, lighting, photography, and the handcrafted nature of our products.
Product photographs may also represent examples of previous designs. Unless specifically stated otherwise, decorations and placement may vary slightly.
6. Pricing & Payment
All prices are displayed in U.S. dollars unless otherwise stated.
Prices may change at any time without notice. Price changes will not affect orders that have already been accepted and paid for unless an obvious pricing error occurred.
Applicable taxes, shipping charges, delivery charges, customization fees, or other charges will be displayed during checkout when applicable.
Payment must be successfully completed before an order is processed unless another arrangement has been expressly approved by SweetNote.
7. Order Acceptance
Receiving an order confirmation does not necessarily mean that we have accepted your order.
We reserve the right to refuse, limit, or cancel an order when reasonably necessary, including because of:
- Product or ingredient availability
- Pricing or listing errors
- Suspected fraud
- Payment issues
- Production limitations
- Delivery limitations
- Inappropriate personalization requests
- Errors in product information
If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.
8. Order Changes & Cancellations
Because our products are handcrafted and frequently personalized, please contact us immediately if you need to change or cancel an order.
If production has not started, we may be able to accommodate your request.
Once production has begun, we cannot guarantee changes or cancellations.
Personalized products that have entered production are generally final sale.

9. Shipping & Delivery
Where shipping or delivery is offered, estimated delivery dates are estimates and are not guaranteed unless we expressly state otherwise.
SweetNote is not responsible for delays caused by circumstances outside our reasonable control, including carrier delays, severe weather, service disruptions, incorrect addresses, or other transportation issues.
Customers are responsible for providing accurate and complete shipping information.
If an incorrect or incomplete address is provided, additional shipping or replacement charges may apply.
10. Local Pickup
Where local pickup is offered, customers are responsible for collecting their order within the agreed pickup period.
Because our products are edible and often made specifically for the customer, failure to collect an order does not automatically qualify the customer for a refund.
Customers should contact us as soon as possible if they cannot collect their order as scheduled.
11. Chocolate & Temperature Sensitivity
Chocolate is sensitive to temperature, sunlight, humidity, and handling.
Customers are responsible for properly storing products after delivery or pickup and for retrieving delivered packages promptly.
SweetNote is not responsible for melting or deterioration caused by products being left outdoors, inside vehicles, in direct sunlight, in warm buildings, or otherwise improperly stored after delivery or pickup.
12. Food Allergies
SweetNote products may contain or come into contact with common allergens, which may include:
Milk, soy, peanuts, tree nuts, wheat, and other allergens.
Ingredients and allergen information may vary by product.
Customers are responsible for reviewing available ingredient and allergen information before purchasing or consuming our products.
If you or the intended recipient has a serious food allergy, please contact SweetNote before placing an order.
We cannot guarantee that any product is completely free from cross-contact with allergens unless expressly stated.
13. Food Storage & Consumption
Customers are responsible for following any storage, handling, or consumption instructions provided with their order.
Products should not be consumed if they appear spoiled, contaminated, improperly stored, or otherwise unsafe.
14. Returns & Refunds
Because SweetNote sells edible and personalized products, most purchases are final sale.
Returns, refunds, replacements, damaged-order claims, and cancellations are governed by our separate Return & Refund Policy, which forms part of these Terms.
15. Gift Orders
Customers may purchase SweetNote products for delivery or gifting to another person.
You are responsible for ensuring that the recipient's name, address, personalization, dietary considerations, and other information you provide are accurate.
If you provide another person's personal information to us, you represent that you have a legitimate reason to provide that information for purposes of fulfilling the order.
16. Promotions & Discount Codes
Promotional offers, discounts, and coupon codes may be subject to additional terms.
Unless otherwise stated:
- Promotions cannot be combined.
- Discounts cannot be applied retroactively.
- Promotional codes have no cash value.
- Promotions may be limited or discontinued at any time.
- Certain products may be excluded.
SweetNote reserves the right to cancel or refuse promotional discounts that are used fraudulently or contrary to the stated terms of the promotion.
17. Intellectual Property
The SweetNote name, branding, logos, website content, product photographs, graphics, designs, written content, packaging concepts, and other original materials owned by SweetNote are protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, sell, modify, publish, or commercially use our protected materials without permission.
Nothing contained on our website grants you ownership or a license to use SweetNote intellectual property except as expressly permitted.
18. Customer Content & Personalization
When you submit a name, message, photograph, design request, or other content for personalization, you represent that you have the right to provide and use that content.
You may not submit content that infringes another person's copyright, trademark, privacy, publicity, or other rights.
You remain responsible for the content you submit.
19. Reviews & User-Submitted Content
If you voluntarily submit a review, photograph, testimonial, comment, or other content to SweetNote, you represent that the content is truthful and that you have the right to provide it.
We may display customer reviews and testimonials on our website or marketing materials as permitted by applicable law and any permissions you provide.
20. Third-Party Services
Our website may use or link to third-party services, including payment processors, delivery providers, social media platforms, applications, and other service providers.
Your use of third-party services may be subject to their own terms and privacy policies.
SweetNote is not responsible for the independent actions, websites, or services of third parties except where responsibility cannot legally be excluded.
